The Irish Congress of Trade Unions ICTU has made a formal complaint to the European Court of Human Rights on the state’s failure to uphold an effective right to collective bargaining, in breach of the European Convention on Human Rights. The complaint was lodged in the name of Congress and the Technical, Engineering & Electrical Union (TEEU) and was prepared by John Hendy QC. It is pinpointing the McGowan case which resulted in tens of thousands of workers being denied the effective right to collective bargaining, which is an essential element of Article 11 of the European Convention on Human Rights and Fundamental Freedoms.
